Depending on the state of residence, banks employ two different methods to foreclose on homeowners; judicial foreclosure or non-judicial trustee foreclosure.
In a judicial foreclosure state, a neutral 3rd party judge will review the foreclosure documents, specifically looking for errors and mistakes. After the review process, the judge will then decide whether or not to postpone, cancel, or proceed with the auction.
In non-judicial trustee states, there is no judge or review process, and therefore the homeowner does not have the same protection.
Instead of a judge, there is a trustee tasked with orchestrating the foreclosure process. The trustee is always employed by the lender, so essentially the homeowner is playing in an arena where the trustee or “referee” is playing for the other team. At the same time, the trustee needs to protect themselves and the lender from wrongful foreclosure if you challenge their actions. That is where Stop Foreclosure Network comes in.
